Terms Of Service

🩵-GENERAL-🩵

• If you have any questions regarding commissions or you are interested in one, please ask via any of my socials.
• Commissions are for Personal Use only unless commercial rights are purchased (Additional fees apply.) You may however use the commission for personal use such as profile pictures, banners, posting on Socials with Credit, or printing for yourself. The commission may not be used for profit without prior agreement.
• AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.
• Communication is important. If I do not receive a response within 3 days to due date, I will proceed and deliver the artwork as is or it will be put on hold and placed next in line in my queue (continued failure to respond will push it further down the queue). once seen if needing changes, I will make them in my spare time.
If I am not comfortable with what you desire for your commission or how I am treated, I have every right to refuse to work for you.
• You may not steal, copy, trace, edit, recolour, sell for profit, or make bases out of my artwork. You may not post my art on other sites without my permission, alter my art in any form or way (including AI) nor claim as your artwork.

🩵-PAYMENT AND REFUND POLICY-🩵

• I only accept USD currency unless discussed prior. Payment is made via PayPal and Ko-Fi.
• All payments are upfront in full through the agreed platform and will need to be received BEFORE I start a commission.
• After receiving a sketch, if for whatever reason you are unhappy with the draft, half of full payment to any requested refunds will be sent back to you. If you request a refund before being delivered a sketch, you will receive back the full price you paid. However, refunds are not an option or negotiable once the sketch has been approved.

• You receive 2 free revisions (sketch stage and flat colour stage). Additional revisions cost $5 each, paid before I continue. Please provide all necessary feedback at the stated stages.
• A Non-Disclosure Agreement (NDA) fee of $50 applies if you request that I do not post your commission publicly or use it as part of my Portfolio.
• If a commissioner wishes to buy Commercial Use AFTER a commission is completed, Merchandise Commercial Use will cost $50-100 depending on the piece.

Chargebacks are strictly prohibited.
Filing a chargeback will:
• Forfeit your rights to use the artwork.
• Allow me to resell or reuse the artwork as I see fit.
• Result in a formal complaint against you.

Any refunded sketches will go towards my own characters or used however I see fit. PayPal users: remember to send payment via goods and services, select no shipping required, and please include your username and/or what the payment is for.

🩵-ARTWORK PROCESS-🩵

• Revisions are only available during the sketch and flat colour phases.
• Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost.
• If you wish to skip the Queue and be Priority, Rush fee is $20+ depending on your current place in the queue. You will have to Directly Message me or state in the Request forms that you wish for a Rush Fee. You may request a rush fee at any time.
• As the commissioner, it is your responsibility to provide and link a proper ref of the character you would like to have drawn.
• Major changes will not be made after completion, so be sure to mention if you would like anything changed during the revision stages.
• Please be specific on any details that you find important for your commission (character personality and information, clothing, aesthetic/atmosphere, etc). I am not held responsible for any details you left out that you wanted shown in the commission.
• Please be patient as some commissions may take longer than others. Real Life situations can get in the way of completing a commission. If it is something big, I will try to let everyone know.

🩵-INTELLECTUAL PROPERTY RIGHTS-🩵

I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.

I may use the artwork to:
• Promote myself and my services.
• Post on social media and in my portfolio.
• Create prints/merchandise (fanart).
Exceptions: If an NDA was purchased, the artwork will not be posted or used for promotional purposes.

🩵-EMOTES-🩵

• If using on Twitch, please attribute them to me >> @FlugelQuin << or give credit.
• Please make it known, prior to sending payment, if you would like to receive revisions for your emote commissions. I say this as emotes are relatively quick to complete, unless animating them, and I do not provide revisions for these commission types.
• Animated emote commissions receive 1 free revision at the animated sketch stage
• So long as you attribute them to me on Twitch, you do not need to pay a commercial fee when buying the emotes made by Loumon.

🩵-FINAL AGREEMENT-🩵

• As previously stated, I am not held responsible for any details you left out that you wanted shown in the commission.
By commissioning me, you acknowledge that you have read, understood, and agreed to all the terms above.
